Overview

El-Mal3ab application is the first sports specialist application in Qatar for reserving different type of sports fields (football – basketball – squash – padel – tennis … etc)

Throughout the “El-Mal3ab” application, the terms “we”, “us” and “our” refer to “El-Mal3ab” management.

“El-Mal3ab” offers this application, including all information, tools and services available from this application to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our application and/or reserving any service from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and / or available by hyperlink. These Terms of Service apply to all users of the application/site, including without limitation users who are browsers, vendors, customers, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our application “El-Mal3ab”. By accessing or using any part of the application, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the application or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current application/site shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our application. It is your responsibility to check this page periodically for changes. Your continued use of or access to the application following the posting of any changes constitutes acceptance of those changes.

SECTION 1 – ONLINE APPLICATION TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in the State of Qatar, or that you are the age of majority in the State of Qatar and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – MINORS

The Services are not designated to users under the age of Majority in the state of QATAR. If you are under the majority age in the state of QATAR, you should not use the Services nor provide any Personal Information to us.

We reserve the right to access and verify any Personal Information collected from you. In the event that we become aware that a user under the age of majority in the state of QATAR has shared any information, we will discard such information. If you have any reason to believe that a minor has shared any information with us, please contact us at info@el-mal3ab.com.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this application is not accurate, complete or current. The material on this application is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this application is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our application. You agree that it is your responsibility to monitor changes to our application.

SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our services/products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 – CANCELLATION AND REFUND

The customer may be allowed to cancel some of the purchased services/reserved fields,  before providing the service, while some purchased services/reserved fields may not be allowed to be cancelled with no refund allowed depending on the time of the cancellation, type of fields or location.

Cancellation of any service/reservation will follow our cancellation policy.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities of reservation per person. These restrictions may include orders placed by or under the same user account, the same credit card. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or application notification /phone number provided at the time of registration. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases/reservations made at our application. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the application (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

SECTION 8 – THIRD-PARTY LINKS

Certain content, products and services available via our Service may include materials from third-parties.

Third-party links on this application may direct you to third-party websites / application that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites / application. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 10 – PRIVACY POLICY

We, at “El-Mal3ab” application /website, respect your privacy and are committed to protect the privacy of our users (“user” or “you”). We have created this Privacy Policy to inform you about how we manage, collect and use your information through your use of our mobile application as well as any of our online services or software.

The Privacy Policy is a part of our End User License Agreement and is incorporated therein by references. We encourage you to read the Privacy Policy carefully and use it to make informed decisions. By using our Services, you agree to the terms of this Privacy Policy and your continued use of the Services constitutes your ongoing agreement to this Privacy Policy.

We collect two types of data and information from our users:

The first type of information is un-identified and non-identifiable information pertaining to a user(s), which may be made available or gathered via your use of the Services (“Non-personal Information”). We are not aware of the identity of the user from which the Non-personal Information was collected. Such information includes the following Technical information: In order to enhance the functionality of the Services and to provide you with a better user experience, we collect technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time and the domain name from which you linked to the Services; etc.).

Analytics information: We collect information about your use of the Services, such as applications’ usage, log files, user activity (e.g. pages viewed, the amount of time spent on particular pages, online browsing, clicks, actions, installs, etc.), time stamps, alerts, etc. This information is collected for amongst other things troubleshooting errors and bugs as well as for research and analytics purposes about your use of the Services.

Anonymous information: We may anonymize or de-identify the information collected by the Services or via other means so that the information cannot, on its own, personally identify you. Our use and disclosure of such aggregated or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation and for any purpose.

The second type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Information”), which includes the following: Voluntary information: We collect information which you provide us voluntarily. For example, when you respond to communications from us, communicate with us via email or share additional information about yourself through your use of the Services. In addition, we may collect from users who use Android Operating System their Google email address.

User Submissions: We permit you and other users to upload, post or otherwise make available data, text, graphics, images, messages or other materials (“User Submissions “) on the Services (e.g. via online discussion forums and chat facilities), which may include Personal Information. We as well as other users may see and share any of your User Submissions that you make publicly available through the Services.

Device information: We may collect specific types of connection details and information with regard to your device and hardware that may identify from where you are using our Services, such as your IP address.

Social networks: When you choose to connect our application and Services to your social network account (such as your Facebook account), we will have access to basic information from your social network account, such as your name, birthdate, profile picture and friends’ list, as well as information you made publicly available on such account. We will use the Personal Information for the purposes set out herein and disclose such information only to third parties as detailed in this Privacy Policy.

If we combine Personal Information with Non-personal Information, the combined information will be treated as Personal Information for as long as it remains combined.

– COOKIES

We use cookies, web beacons and other technologies or methods of web analysis to gather, store, and track certain information related to your visit to and activity through the Services.

A cookie is a piece of data stored on your browser containing information about your access to the Services. We and our trusted partners may use such cookies for various different purposes. These purposes include allowing you to navigate between pages efficiently, enable automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier.

We may use different types of cookies:

(i) ‘session cookies’ which are stored only temporarily during a browsing session in order to allow normal use of the system and are deleted from your device when the browser is closed;

You may remove the cookies by following the instructions of your web browser; however, if you choose to disable cookies, some features of our Services may not operate properly and your online experience may be limited. In addition, we may use web beacons (electronic images that allow us to count users who have accessed a particular page in our application and to access certain cookies) as well as other technologies which collect mainly Non-personal Information connected to your browsing tendencies. We use such technologies for routine operation, including for the collection of statistical data about your use of our Services (e.g. your views, clicks, installs, etc.), for advertising purposes and in order to adapt the Services to your personal preferences. The information collected through such tracking technologies may be transferred to third parties which provide technical diagnostics and analytic tools on our behalf.

HOW WE USE THE INFORMATION WE COLLECT?

We use and share Personal Information in the manners described in this Privacy Policy. In addition to the purposes listed above, the information we collect, which may include your Personal Information, is used for the following purposes:

To identify and authenticate your access to certain features of the Services;

To communicate with you and to keep you informed of our latest updates;

To send you marketing communications regarding special offers, products, services and periodic newsletters;

To serve you advertisements when you use our Services;

To perform a research or to conduct anonymous analytics in order to improve and customize our Services to your needs and interests;

To test changes to the Services and make improvements to their functionality;

– SHARING OF PERSONAL INFORMATION

We do not trade, sell, or otherwise share your Personal Information with third-parties except as set out in this Privacy Policy.

In addition to the different uses listed above, we may transfer or disclose Personal Information to our subsidiaries, affiliated companies and our trusted partners who provide the services within our application.

In addition, we may transfer or disclose Personal Information with other trusted third party service providers or partners, who are located in different jurisdictions across the world, for the purpose of:

(a) storing or processing such information on our behalf;

(b) assisting us with our business operations and the providing and improvement of our Services;

(c) performing research, technical diagnostics and analytics with regard to the Services.

We may also disclose Personal Information, or any information you submitted via the Services if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to:

(i) comply with any applicable law, regulation, legal process or governmental request;

(ii) enforce our policies (including our Agreement), including investigations of potential violations thereof;

(iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues;

(iv) to establish or exercise our rights to defend against legal claims;

(v) prevent harm to the rights, property or safety of us, our users, yourself or any third party;

or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

We may also share Non-personal Information or anonymized information with other third parties for different purposes, such as marketing or advertising (see below specific information with regard to our advertising practices, under “Advertisements”).

– THIRD PARTY COLLECTION OF INFORMATION

Please keep in mind that this Privacy Policy does not apply to any third party’s websites, services or applications, even if they are accessible, downloadable, or otherwise distributed through the Services. You should always review their privacy practices carefully before providing Personal Information to such third parties.

You are knowingly and voluntarily assuming all risks of using any third-party websites, services or applications. You agree that we shall have no liability whatsoever with respect to such third party sites and your usage of them.

– HOW DO WE SAFEGUARD AND TRANSFER YOUR INFORMATION?

We take great care in implementing and maintaining the security of the Services and your information. We employ industry standard procedures and policies to ensure the safety of our users’ information, and prevent unauthorized use of any such information. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Services, and we make no warranty, express, implied or otherwise, that we will prevent such access. Since we operate globally, it may be necessary to transfer your Personal Information to countries outside Qatar or outside the GCC region.

– FOR HOW LONG WE RETAIN THE INFORMATION WE COLLECT?

We value your privacy and control over your Personal Information, and therefore you may, at any time, request to change and update it by emailing us at info@el-mal3ab.com. You can also request that we will correct errors or that we will erase your Personal Information (except for data that we are required to keep under applicable laws) by emailing us. Please note that unless you instruct us otherwise we retain the information we collect for as long as needed to provide the Services and to comply with our legal obligations, resolve disputes and enforce our agreements. We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

– CORPORATE TRANSACTION

We may share Information, including Personal Information, in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale of an asset or transfer in the operation thereof) of the Company. In the event of the above, the acquiring company or transferee will assume the rights and obligations as described in this Privacy Policy.

– UPDATES

We may revise this Privacy Policy from time to time, in our sole discretion, and the most current version will always be posted in our application.

We encourage you to review this Privacy Policy regularly for any changes.

Your continued use of the Services, following the notification of such amendments in our application, constitutes your acknowledgement and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.

SECTION 11 – ADVERTISEMENTS

We may use advertising technology to serve advertisements (including targeted ads) when you use our Services. This technology may use Non-personal Information with regards to your use of the Services to serve advertisements to you. We may also use third parties and share with them Non-personal Information to assist us in evaluating the success of our advertising campaigns and help us retargeting our users. You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”). – ID AND ADVERTISING IDENTIFIER

The Google Advertising ID is an anonymous identifier, provided by Google Play services. If your device has an Advertising ID, we will collect and use it for advertising and user analytic purposes. We may also use Apples’ Advertising Identifier (IDFA), which is a non-permanent device identifier provided by Apple, and any information obtained through the use of the Advertising Identifier, for the purpose of advertising.

By downloading or using our Services you explicitly agree that we may associate your Advertising ID and your Advertising Identifier with your applicable persistent device identifier. This will facilitate our ability to improve your personalized experience. Further, we may use other persistent identifiers for non-advertising purposes.

If your device does not have Advertising ID or Advertising Identifier respectively, we will use other identifiers.

SECTION 12 – PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the application / site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, national, or Qatar regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related application / website, other application / websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 14- INDEMNIFICATION

You agree to indemnify, defend and hold harmless our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Qatar.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 21 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

I acknowledge that the above provided information is factually correct.

I therefore by agreeing to this disclaimer released by this application (El-Mal3ab), Community Development, Community Engagement, the instructors and all people concerned with the program/activity will not be liable to any injury or accident that maybe incurred by any participant.

The El-Mal3ab application, Community Development, Community Engagement reserves the right to modify, cancel or make adjustments to the program when deemed necessary. The El-Mal3ab application, Community Development, Community Engagement shall not be responsible for lost, stolen or broken equipment or property of any participant.

By registering in this activity/ event I give permission for the taking and/ or publication of still and moving images of my participant/s by the designated photographer(s). I further understand that photographs and film maybe used in or on any appropriate Qatar marketing websites, media and communications activity, such as adverts, literature, branding, and publications via electronic and social media platforms.

I confirm this participant/s is not subject to family, care or legal proceedings, or other proceedings that may affect the publication of images

I agree to sign up my participants for the above class and will pay the full amount due to guarantee his/her place before the class starts.

I hereby give my full consent and approval for the participants, and I understand that there are certain risks of injury inherent in the practice and play of the mentioned sports, as well as in traveling and other related activities incidental to my mentioned participants, and I assume these risks on behalf of all my mentioned participants, I also authorize the representatives to undertake any needed first aid action without limitation even taking me to a hospital in Doha in the case of emergency.

I hereby confirm that my participants are fully capable of participating in the designated sports / activities and are healthy and have no physical or mental disabilities or infirmities that would restrict their full participation.

I do herby waive, release and hold harmless the “El-Mal3ab application” and the registered playgrounds and its landlord, its officers, coaches, sponsors, supervisors and representatives for any injuries that may be suffered by the registered participants in the designated sports or location whether resulting from negligence or any other cause.

By using or visiting the “El-Mal3ab” platform, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the “El-Mal3ab”platform.

By agreeing to the Terms and Conditions of use, you are also agreeing to the Terms of the “El-Mal3ab” Privacy Policy.

1. Permitted Use of the “El-Mal3ab” platform

You agree that you are only authorized to visit, view and to retain a copy of pages of “El-Mal3ab” platform for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this site for any purpose other than to review an event and its promotional information, for personal use, or to purchase tickets for your personal use, unless otherwise specifically authorized by “El-Mal3ab” to do so.

To the extent permitted by law, where “El-Mal3ab” has no control over these web sites / applications or the content contained within them, “El-Mal3ab” cannot guarantee, represent or warrant that the content contained in third party websites is accurate, legal and/or inoffensive.

“El-Mal3ab” does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer in a harmful or damaging way. By using the “El-Mal3ab” platform to search for or link to another site, you agree and understand that you may not make any claim against “El-Mal3ab” for any damages or losses, whatsoever, resulting from your use of the “El-Mal3ab” platform to obtain search results or to link to another site. If you have a problem with a link from the “El-Mal3ab” platform, please notify us at info@el-mal3ab.com and we will investigate the problem you describe in your email and take actions that we deem are appropriate in our sole discretion.

3. Unauthorized Use of the “El-Mal3ab” platform

Illegal and/or unauthorized uses of the “El-Mal3ab” platform, whether for unauthorized ticket sales, unauthorized framing of or linking to the “El-Mal3ab” platform will be investigated and appropriate legal action will be taken.

4. Violation of these Terms and Conditions

If you violate these Terms including if you post or provide User Content which violates these Terms or has violated the rights of “El-Mal3ab”, any other User or the law, “El-Mal3ab” may terminate your use of the “El-Mal3ab” platform, prevent you from making all future bookings using the “El-Mal3ab” platform, and/or take legal action against you. Where this occurs, “El-Mal3ab” will provide you with reasonable prior written notice that this will be implemented, together with reasons for that action being taken.

If you materially violate these Terms “El-Mal3ab” may cancel your ticket orders or purchases or bookings in which case “El-Mal3ab” shall follow its cancellation policy.

You agree that monetary damages may not provide a sufficient remedy to “El-Mal3ab” for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations.

“El-Mal3ab” may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. This is in addition to any other uses permitted under our Privacy Policy.

“El-Mal3ab” is not required to provide any refund to you if you are terminated as a user because you have violated these Terms, except as expressly set out in these Terms.

SECTION 22 – COPYRIGHT POLICY:

“El-Mal3ab” Copyright Policy You may only submit content to the “El-Mal3ab” platform (“User Content”) where you have the rights to do so. In particular, you:

a) May not use the “El-Mal3ab” platform to unlawfully transmit copyrighted material (including articles, images, stories and software) without a license, express consent, valid defense or fair use exemption to do so.

b) You must ensure that the content you upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights).

SECTION 23 – DISCLAIMERS:

a) “El-Mal3ab” cannot ensure that files you download from the “El-Mal3ab” platform will be free of viruses or contamination or destructive features although “El-Mal3ab” will take steps consistent with industry practice to protect against this occurring.

b) “El-Mal3ab” does not by these Terms exclude any rights and remedies in respect of goods or services under the relevant Trade Practices Act of Qatar Laws, or equivalent state or territory legislation, which cannot be excluded, restricted or modified. However, “El-Mal3ab” excludes all rights, remedies, conditions and warranties in respect of goods or services from your use of this site and the “El-Mal3ab” platform whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible, the following paragraphs of this clause 7 will apply.

c) “El-Mal3ab” will not be liable for any damages of any kind arising from the use of the “El-Mal3ab” platform, including without limitation, direct, indirect, incidental, and punitive and consequential damages.

d) “El-Mal3ab” makes no guarantee of any specific result from use of the “El-Mal3ab” platform or use of the “El-Mal3ab” service.

e) “El-Mal3ab” disclaims any and all liability for the acts, omissions and conduct of any third party users, “El-Mal3ab” users, advertisers and/or sponsors on the “El-Mal3ab” platform, in connection with the “El-Mal3ab” service or otherwise related to your use of the “El-Mal3ab” platform and/or the “El-Mal3ab” service. “El-Mal3ab” is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the “El-Mal3ab” platform.

f) Without limiting the other provisions of this policy, you may report the misconduct of users and/or third party advertisers, service and/or product providers referenced on or included in the “El-Mal3ab” platform to “El-Mal3ab” info@el-mal3ab.com. “El-Mal3ab” may investigate the claim and take appropriate action, in its sole discretion.

g) “No Show” “El-Mal3ab” shall follow the cancellation policy.

SECTION 24 – PAYMENT METHODS:

“EL-Mal3ab” processes your payment depending upon the methods accepted by the PLAYGROUND/EVENT/MY FATOORAH/ANY OTHER ORGANISER which may include but are not limited to credit cards: Visa, MasterCard, Bank Card and American Express, loyalty programs, cash and other means of payment for the services and product.

SECTION 25 – LIMITS ON TICKETS PURCHASES PER CUSTOMER:

When purchasing on “El-Mal3ab”, you are limited to a maximum number of tickets / Purchases / bookings / events per transaction. This is often a limit of 5 tickets unless otherwise specified by the event organizer and may be as low as 1 ticket per transaction. If you try to circumvent the “El-Mal3ab” platforms to purchase more than 5 tickets the EVENT ORGANISER may at its discretion cancel additional bookings. This limitation has been designed to prevent unfair buying practices at popular events and make sure everyone gets a fair chance of attending the event.

However, “El-Mal3ab” will hold the rights to clear more than 5 tickets / Purchases / bookings / events where a detailed understanding of the requirement is established

SECTION 26 – PRICING AND TICKET AVAILABILITY:

a) “El-Mal3ab” sells on behalf of tickets / Purchases / bookings / events / others which means “El-Mal3ab” does not determine the prices, booking fees, postage and handling fees (if posted tickets are an option) or the seating selections.

b) Tickets / Purchases / bookings / events / others inventory is the responsibility of the Tickets / Purchases / bookings / events / ORGANISER/ others. Given inventory set by the Tickets / Purchases / bookings / events / ORGANISER/ others, popular events may sell out quickly. Occasionally, additional tickets may be available in addition to inventory using “El-Mal3ab” set by the Tickets / Purchases / bookings / events / ORGANISER/ others, however the Tickets / Purchases / bookings / events / ORGANISER/ others controls this inventory and its availability.

c) “El-Mal3ab” reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the “El-Mal3ab” platform. “El-Mal3ab” further reserves the right to alter any and all fees from time to time, without notice.

d) You shall be liable to pay all applicable charges and fees like and not limited to per ticket internet handling fee, a non-refundable per order processing fee, duties, taxes, levies and assessments for availing the “El-Mal3ab” platform.

e) If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on the “El-Mal3ab” platform or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then “El-Mal3ab” will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of the “El-Mal3ab” platform.

SECTION 27 – CREDIT CARD PURCHASE AND PROOF OF IDENTITY:

a) In most cases where you purchase your tickets using a credit card, in order to collect your tickets, you will be required to present the credit card, debit card, Loyalty card, any other medium used to purchase tickets and a picture identification, which must match each other and must match the name under which the booking was made.

b) All purchases are charged to your credit card, Debit card, Loyalty card and other medium used at the time of purchase, not at the time of entry to the event.

c) All transactions once completed and confirmed are not exchangeable or refundable under any circumstances. No refunds or exchanges will be entertained if you do not turn up to collect your tickets.

SECTION 28 – LICENSED VENUES AND PROOF OG IDENTITY:

“El-Mal3ab” sometimes sells tickets for events at licensed venues, and these venues require a valid driver’s license, passport or proof of age to prove you are over 18 years of age. You may need to present this proof at the event venue to obtain admission.

Please check the censor warning before buying the tickets or booking the venue or making any purchases on “El-Mal3ab”.

SECTION 29 – DELIVERY OF TICKETS:

A) BY “EMAIL / E-TICKET” OPTION:

The “El-Mal3ab” platform provides an opportunity for you to provide your email address and will attempt to deliver your e-ticket by email to that email address. If you do not receive your e-ticket then please contact “El-Mal3ab” by email info@el-mal3ab.com at least 48 hours before the scheduled event

B) QUICK PURCHASES

I. With mobile phone bookings charges will be made to the credit card stored on your mosh file and it is your responsibility to ensure these credit card details are accurate and updated.

II. Do not set your quick purchase settings or purchase tickets with your parents or another person’s credit card unless you have their permission or have completed a credit card authorization form – as you will not be let into the event – even with a valid ticket.

“El-Mal3ab” takes no responsibility for tickets not purchased through the “El-Mal3ab” platform including web pages; call Centre, outlets and authorized retailers.

SECTION 30 – EVENTS ARE SUBJECT TO FORCE MAJEURE CONDITIONS:

It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavors to notify ticket holders of the cancellation once we have received the relevant authorization from the Event Organizer. We do not guarantee that ticket holders will be informed of such cancellation before the date of the event.

No refund is applicable, if the event is cancelled or curtailed due to unforeseen circumstances after commencement of the event.

SECTION 31 – RESERVATION CANCELATION POLICY:

In case you have cancelled a paid reservation on the App, it’s subject to the below policy:

  • Cancellation before 48 hours of the date and time of the reservation, you will get a voucher with 100% of the paid amount, this voucher is valid for another reservation on the same sports filed you have cancelled the related reservation and also valid for 30 calendar days.
  • Cancellation between 48 to 12 hours of the date and time of the reservation, you will get a voucher with 50% of the paid amount, this voucher is valid for another reservation on the same sports filed you have cancelled the related reservation and also valid for 30 calendar days.
  • Cancellation less than 12 hours of the date and time of the reservation, you will not get any voucher but we will keep record and in case you canceled 3 times, we will consider you a reliable customer.
